'Bob's Burgers' Actor Sentenced to 1 Year in Prison for Jan. 6 Role

Background of the Case

David Hernandez, who provided the voice of Teddy on the popular animated sitcom “Bob's Burgers,” was sentenced to 12 months in prison for his participation in the January 6, 2021 attack on the U.S. Capitol. Hernandez had pleaded guilty in June 2022 to a misdemeanor charge of entering and remaining in a restricted building or grounds without lawful authority.

Details of Hernandez's Involvement

According to court documents, Hernandez entered the Capitol through a broken window and remained inside for approximately 20 minutes. While there, he filmed himself and others inside the building. Hernandez also admitted to smoking marijuana during the riot.

Hernandez's attorney argued for leniency, citing his lack of a criminal record, his remorse for his actions, and his status as a primary caregiver for his disabled mother. However, U.S. District Judge Trevor McFadden rejected the request, stating that Hernandez's actions undermined the democratic process and showed a lack of respect for the rule of law.

Assistant U.S. Attorney Jessica Fender recommended a sentence of 15 months in prison, arguing that Hernandez's actions were part of a larger conspiracy to overturn the results of the 2020 presidential election. Fender also cited Hernandez's lack of remorse and his continued support for the former president who incited the riot.

Hernandez's sentencing comes as part of a broader crackdown on individuals who participated in the January 6 attack. More than 950 people have been charged in connection with the riot, and over 500 have pleaded guilty. Many of those who have been sentenced have received prison time, with some receiving sentences of up to 5 years.

Hernandez's sentencing is a reminder that even those who participated in the January 6 attack in a seemingly minor way can face serious consequences. It also highlights the continued efforts by the Department of Justice to hold accountable those who sought to undermine American democracy.
