Trademark Nikita Mikhalkov: Russian director loses exclusive rights to the trademark
Nikita Mikhalkov lost exclusive rights to the trademark – court
The Arkhangelsk Arbitration Court satisfied the claim of the Russian company Tehnopark-Service LLC against the famous Russian director Nikita Mikhalkov and deprived him of the exclusive right to the trademark “Nikita Mikhalkov”. This was reported by RIA Novosti with reference to the court decision.
The lawsuit was filed with the court back in June 2022. The plaintiff argued that back in 2001, Mikhalkov transferred the exclusive right to the trademark to the company Soyuz TM. However, in 2018, this right was transferred to Tehnopark-Service LLC, which sued the director.
The court found that the assignment agreement between Mikhalkov and Soyuz TM was fictitious and the transfer of exclusive rights did not actually take place. As a result, the exclusive right to the trademark “Nikita Mikhalkov” was recognized by the court as belonging to Tehnopark-Service LLC.
The court's decision comes into force in one month, if it is not appealed
As reported by TASS, the decision of the Arkhangelsk Arbitration Court can be appealed within one month. If the decision is not appealed, it will come into force one month after its adoption.
It is worth noting that the conflict over the trademark “Nikita Mikhalkov” has been going on for several years. In 2018, the director filed a lawsuit against the company Tehnopark-Service LLC, demanding that it be prohibited from using his trademark. However, the court dismissed the lawsuit, and the director lost the exclusive right to the trademark.
